1. Who we are

This website, [www.byelbo.com] (the "Site"), is operated by Elena Botti, freelance professional, VAT number IT01735400333, Italy. You can contact us at byelbo@elenabotti.com].

By using the Site you agree to these Terms. If you don't agree, please don't use it.

2. What the Site is

The Site presents the By Elbo brand, our artwork and products, and our creative services. It is a showcase, not an online store. Products are sold through third-party marketplaces, currently Etsy and Spoonflower.

3. Purchases on Etsy and Spoonflower

  • When you click a button that leads to Etsy or Spoonflower, you leave the Site. Your purchase is a contract between you and that platform and is governed by its own terms and policies.

  • Payment, shipping, delivery, tracking, returns and refunds are handled according to the policies of the platform where you buy. Please read them before ordering.

  • Many By Elbo pieces on Etsy are made to order, so exchanges and returns are not available for them. If an item arrives damaged, contact us with your order number and we'll do our best to help. This does not limit any rights you have by law.

  • Prices, availability and product details shown on the Site are for information only. The information on the platform at the time of purchase prevails.

  • We are not responsible for the platforms' services, availability or policies.

4. Intellectual property

All content on the Site, including artwork, illustrations, patterns, lettering, designs, photographs, text, logos and layout, is owned by By Elbo or used with permission, and is protected by copyright and other laws. © [2026] By Elbo. All rights reserved.

You may view the Site and share links to it. Without our written permission, you may not copy, reproduce, modify, distribute, sell, display publicly or use our content for commercial purposes, nor use it to train artificial intelligence or machine learning models. Buying a product does not transfer any copyright in the artwork.

5. Free downloads

Free downloads, such as the sticker pack offered to the Color Club subscribers, are provided for personal use only. You may print them for yourself and use them in your planner, notebooks and devices. You may not resell, share, redistribute or upload the files, sell products made from them, or present the artwork as your own.

6. Newsletter (The Color Club)

If you subscribe, you agree to receive emails from By Elbo, up to four per month, with news, new designs and offers. You can unsubscribe at any time using the link in every email. See the Privacy Policy for how we use your data.

7. Creative services and custom projects

By Elbo offers custom illustration, surface pattern design and artwork for brands, in limited numbers each season.

  • Sending an enquiry through the Site does not create a contract. A project begins only when both parties agree in writing on a quote or agreement.

  • Each project is governed by its own written agreement. If it conflicts with these Terms, the written agreement prevails.

  • The agreement will normally cover: scope and deliverables, timeline, number of revision rounds, price and payment schedule (including any deposit), what rights the client receives and when (typically on full payment), and our right to show the finished work in our portfolio unless otherwise agreed.

  • Details of a project may be treated as confidential if agreed in writing.

8. Client work, reviews and testimonials

We display client projects and customer reviews only with the permission of the people involved. If you appear in our content and would like it removed, contact us at byelbo@elenabotti.com.

9. Acceptable use

You agree not to use the Site unlawfully; attempt to access areas or systems you're not authorized to use; introduce malicious code; scrape or copy it in bulk; or send spam or false information through our forms.

10. Third-party links

The Site links to other websites and services, including Etsy, Spoonflower, Instagram and Pinterest. We don't control them and are not responsible for their content or practices.

11. Disclaimer and limitation of liability

The Site and its content are provided "as is". We do our best to keep information accurate and the Site available, but we don't guarantee it will be error-free or uninterrupted. To the extent permitted by law, By Elbo is not liable for indirect or consequential losses arising from use of the Site. Nothing in these Terms excludes liability that cannot be excluded by law, or limits the mandatory rights of consumers.

12. Governing law and disputes

These Terms are governed by the laws of [Italy / other jurisdiction]. Any dispute will be handled by the courts of [Piacenza, Italy], without prejudice to any mandatory consumer protections of your country of residence.
