2. Description of Services

ELBO is a surface design studio that provides both digital assets and future physical collections, divided into two distinct operational branches:

  • ELBO Visual: Dedicated to the creation and sale of digital assets, including seamless repeating patterns, digital illustrations, clipart, and product mockups.

  • ELBO Atelier: Dedicated to future projects involving physical textile collections, printed fabrics, digital sewing patterns, and tangible consumer goods.

The website provides information about design services, portfolios, direct links to third-party marketplaces (such as Etsy), and a contact form for custom design inquiries and commercial licensing.

3. Custom Work and Contractual Agreements

Inquiries submitted through the contact form do not constitute a binding contract or a confirmed project. Custom design services and commercial collaborations are strictly subject to a separate process consisting of:

  • Initial project review and evaluation of technical requirements.

  • Provision of a formal commercial quotation and timeline.

  • Execution of a separate, written and signed contract between the parties. No work will commence prior to the execution of such an agreement.

4. Intellectual Property and Copyright

All content displayed on this website, including but not limited to designs, repeating patterns, illustrations, images, text, graphics, logos, and digital arrangement, is the exclusive intellectual property of Elena Botti (ELBO) and is fully protected by Italian and international copyright and intellectual property laws.

The unauthorized copying, reproduction, distribution, modification or commercial exploitation of any content from this website is strictly prohibited without prior written authorization from the owner.

5. Licensing and Usage Restrictions

The purchase or download of any digital asset from ELBO Visual does not transfer ownership or copyright. Usage rights are strictly governed by specific digital end-user licenses or separate written contracts. The following universal restrictions apply to all digital assets:

  • Fabric Printing Limitation: Commercial fabric printing intended for the sale of raw yardage, wholesale textiles, or fabric-by-the-meter is strictly prohibited, unless explicitly permitted under a separate, custom commercial contract.

  • Print-on-Demand (POD): Uploading or distributing ELBO artwork on automated Print-on-Demand, dropshipping, or manufacturing platforms (including but not limited to Spoonflower, Printful, Redbubble) is strictly forbidden.

  • Artificial Intelligence (AI): The use of any content, artwork, or patterns from this website for the purpose of training Artificial Intelligence (AI) models, machine learning algorithms, or data scraping datasets is strictly prohibited.

6. Portfolio and Promotional Rights

Unless otherwise agreed upon in a separate written contract, ELBO reserves the right to display all completed artwork, including custom projects, custom patterns and exclusive brand collaborations, within its online portfolio, website sections, newsletters, and official social media channels for self-promotional purposes.

7. Transactions and Refund Policies

  • Digital Assets (ELBO Visual): Due to the digital nature of instant download products, all sales are final. Pursuant to European consumer law, once the digital download link has been accessed or generated, the right of withdrawal is waived, and no refunds, returns, or cancellations will be issued.   • Third-Party Platforms: Any purchase executed through links to external marketplaces (including Etsy and Spoonflower) is governed exclusively by the terms of service, privacy statements, and transaction policies of those respective third-party platforms. ELBO shall not be held liable for external transactions.

  • Physical Goods (ELBO Atelier): Return policies, cooling-off windows, and shipping conditions for physical textile products will be formally added to this section upon the official commercial launch of the physical collections.

8. User Submissions and Representations

By transmitting project briefs, messages, or materials through the contact form, you represent and warrant that all provided information is accurate, up to date, and that you possess all necessary legal rights and third-party permissions to share such data and creative inputs.

9. Disclaimer of Warranties

This website and its content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. While every effort is made to ensure technical precision, clean vector paths, and perfect repeat alignments, ELBO does not guarantee that the site or its files will be completely error-free.

10. Limitation of Liability and Printing Indemnity

To the fullest extent permitted by applicable law, ELBO (Elena Botti) shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of this website or the deployment of its digital assets.

Manufacturing Disclaimer: The user bears sole responsibility for verifying the file setup before production. ELBO is not financially or legally liable for printing errors, fabric manufacturing defects, or material waste incurred during external production. It is mandatory to run a small test print (strike-off) with your printer before initiating mass production.

11. Privacy Integration

The collection and processing of personal data through this website (including Squarespace form inputs and MailerLite email subscriptions) are strictly governed by our Privacy Policy, which is fully compliant with the European General Data Protection Regulation (GDPR).

12. Governing Law and Jurisdiction

These Terms of Service, along with any separate legal agreements regarding services provided by ELBO, shall be governed by, interpreted, and construed in accordance with the laws of Italy.

Any dispute, controversy, or claim arising out of or relating to the use of this website or commercial purchases made herein shall be subject to the exclusive jurisdiction of the competent Court of Piacenza, Italy.
